Terms and Conditions (T&Cs)
1. General
These Terms and Conditions apply exclusively to legal transactions between Pizza Bella and the responsible pizza delivery service for the corresponding delivery area (hereinafter "Pizza Bella"), as well as their customers in the context of order facilitation through the website pizzabella.fasteat.ch. The services provided by Pizza Bella through the pizzabella.fasteat.ch online ordering service are solely offered in accordance with these Terms and Conditions (hereinafter "T&Cs"). By placing an order, the customer confirms that they have read, understood, and unconditionally accepted the T&Cs. Pizza Bella reserves the right to change the T&Cs at any time. The version of the T&Cs published on pizzabella.fasteat.ch at the time of the order is decisive.
2. Business Activity and Content of the pizzabella.fasteat.ch Online Ordering Service
The pizzabella.fasteat.ch online ordering service allows customers to order food and drinks available at Pizza Bella online. This service is available exclusively for deliveries in Switzerland.
The pizzabella.fasteat.ch online ordering service represents an additional sales channel for the assortment of Pizza Bella. It is possible that the assortment on pizzabella.fasteat.ch differs from that on other ordering channels of Pizza Bella. Restrictions of the online ordering service remain reserved.
3. Order and Delivery
Orders are placed by the customer online on the website pizzabella.fasteat.ch. By placing the order, the customer submits a binding and final offer to purchase the selected products under the stated terms within the ordering process. The acceptance of the order is usually confirmed by Pizza Bella via email. Pizza Bella reserves the right to refuse delivery without giving reasons. The resale of the products is only permitted in Pizza Bella's own stores; resale is generally prohibited.
The minimum order value specified on pizzabella.fasteat.ch for the respective delivery area is binding. If this value is not reached by the ordered products, an additional charge will automatically be calculated to make up the difference between the order value and the minimum order value.
For delivery by the courier service, the customer's address and telephone number, as well as the order, will be recorded. The delivery address must be in Switzerland. All deliveries are made to the address provided by the customer.
Pizza Bella strives to meet the specified delivery times. However, these are non-binding estimated times, for which Pizza Bella assumes no liability. Late deliveries generally do not entitle the customer to cancel the order or request a partial or full refund of the purchase price.
If an order cannot be or can only be difficultly executed for reasons not attributable to Pizza Bella (e.g., incorrect delivery address, customer absence, etc.), Pizza Bella can be released from the delivery obligation unless the customer promptly provides additional information. The customer is not entitled to a re-delivery or compensation for damages.
Due to short delivery times and the perishable nature of the products, orders cannot be changed or canceled, and delivered products cannot be returned or exchanged.
4. Prices and Payment
The prices stated at the time of ordering on pizzabella.fasteat.ch or in the online shop are binding. Prices are stated in Swiss Francs and include delivery costs and VAT.
Payment is made by the customer via debit card, credit card, or Twint on pizzabella.fasteat.ch or in cash upon delivery. Payment by invoice is only possible by prior agreement.
5. Youth Protection
The sale of alcoholic beverages is only permitted to persons aged 16 and over for beer, wine, and cider, and aged 18 and over for spirits, aperitifs, and alcopops. By placing an order on pizzabella.fasteat.ch, the customer confirms they are at least 16 or 18 years old and thus entitled to purchase alcoholic beverages.
When delivering alcoholic products, Pizza Bella may require identity verification. If the customer cannot adequately identify themselves or prove the minimum age, Pizza Bella reserves the right to refuse delivery of such products and cancel this part of the order. Any claims from the customer in this regard are excluded.
6. Duty of Care of the Customer
The customer agrees to provide truthful, accurate, up-to-date, and complete information about their person and delivery address in the order form. Pizza Bella assumes no liability for losses or damages resulting from the failure to fulfill these obligations.
Pizza Bella reserves the right to verify the information and exclude individuals who disregard the T&Cs from the online ordering service.
7. Availability and Modification of the Website pizzabella.fasteat.ch
Although Pizza Bella strives to ensure the highest possible availability of the website pizzabella.fasteat.ch and the pizzabella.fasteat.ch online ordering service, availability cannot be guaranteed.
Pizza Bella reserves the right to modify, interrupt, or discontinue the pizzabella.fasteat.ch online ordering service temporarily or permanently, with or without notice to the customer. Pizza Bella is not liable for such changes, interruptions, or discontinuations.
8. Links
The website pizzabella.fasteat.ch may contain links to other external websites or sources. Pizza Bella has no control over the availability or content of such websites or sources and therefore assumes no responsibility for their content.
9. Warranty and Liability
The customer expressly agrees that the use of the pizzabella.fasteat.ch online ordering service is at their own risk. Pizza Bella may use ingredients and additives that may cause allergies or intolerances. Customers with food allergies are advised to contact Pizza Bella by phone before placing an order to inquire about current allergens.
Pizza Bella is not liable for force majeure events, such as failure of telephone lines or internet connections, labor disputes, governmental actions, unforeseeable failures of transport means or energy, pandemics, or other unavoidable events. This also applies if these events occur with a service provider of Pizza Bella. Pizza Bella is generally not liable for late or incorrect deliveries.
10. Data Protection
Pizza Bella informs the customer that personal data is collected and processed as part of contract fulfillment and for marketing purposes. By accepting these T&Cs, the customer agrees to the processing of their data by Pizza Bella. The processing of personal data is subject to the provisions of the privacy policy.
11. Applicable Law and Jurisdiction
This contract is governed by Swiss law. Disputes are exclusively decided by Swiss courts.
